Terms and Conditions for Participating in the Campaign for the Launch of the new Derbystar Ball for the Bundesliga season 2022/2023
1. Competition
1.1 DFL Deutsche Fußball Liga GmbH, Guiollettstrasse 44-46, 60325 Frankfurt/Main, Germany, ("DFL") conducts an online campaign on DFL’s English-language official account at the social media platform Instagram to promote the launch of the new Derbystar OMB Bundesliga Brillant APS for the Bundesliga season 2022/2023 ("Competition"). Participation in the Competition and how it is conducted are governed by these Terms and Conditions ("Ts&Cs"), which the participant ("User") recognizes as binding upon the User by participating in the Competition.
1.2 The Competition will be conducted from 19 May 2022 upon the publication of the corresponding Instagram post until 23:59 PM (CEST) on 25 May 2022. Any entries for the Competition received after the close for participation will not be considered.
1.3 All Users who take a screenshot of the new Derbystar Brillant APS launch post on DFL’s official Instagram account (moving new Derbystar Brillant APS on a static background) and post such screenshot on his/her own Instagram account by using the hastag #BrillantAPS, as well as follow the DFL’s and Derbystar’s official Instagram accounts will go into the draw to win one of the following 15 prizes:
- 5 x 1 Derbystar Bundesliga Brillant APS 2022/2023 football
- 10 x 1 signed Bundesliga club jerseys (chosen by draw, no claim for a jersey from a certain Bundesliga club or player)
The result of the answers does not affect the User’s chance to win.
2. Authorization to participate and win
2.1 Only individuals who have reached the age of 16 years are entitled to participate in the Competition.
2.2 Participation in the Competition is free of charge.
2.3 The User is responsible for the observation of Instagram’s guidelines and rules which are applicable on the User.
2.4 Any false or fake personal information provided by the User authorizes DFL to exclude him or her from the Competition.
Users who secure an illegal advantage over other Users, or whose entries contain immoral, slanderous, discriminatory, disgusting or other illegal material, or which show or call for illegal activities, or appear to conflict with Instagram's terms of use will also be excluded from the Competition. Automatic computer-generated entries or entries with more than one Instagram account are not permissible and will not be considered. Multiple entries are permitted but will not increase the chance of winning because only one entry will be considered in the draw.
Employees of DFL and companies affiliated with DFL within the meaning of §§ 15 et seq. German Stock Corporations Act (Aktiengesetz, "AktG") and DFL Foundation, employees of licensees, partners and sponsors, contractual partners of DFL and companies affiliated with DFL within the meaning of §§ 15 et seq. German Stock Corporations Act (Aktiengesetz, "AktG") and DFL Foundation as well as the respective relatives of these employees are excluded from participation.
DFL can demand return of a prize that has already been granted in all the above-mentioned situations.
3. Prize notification
3.1 Prizes are limited to one prize per winner.
3.2 Until 1 June 2022 the winners will be selected and notified by Instagram Direct Message and asked to contact DFL within two weeks after the notification has been sent. If the respective winner does not do so, the respective prize will be forfeited and an alternate winner will be selected at DFL’s sole discretion by conducting another draw excluding this winner.
3.3 The claim for the respective prize is not transferrable. A cash payout or payout with physical items is excluded.
4. Data privacy
4.1 In the event that it is necessary for DFL to redeem a prize, DFL may ask the respective winner for additional contact information (e.g. postal address). In the event that a prize is redeemed through retailers or other providers, DFL is entitled to share the contact data of the respective winner with the respective retailer or provider so that they can contact the respective winner. The legal basis for processing is Art. 6 para. 1 sentence 1 b) of the European General Data Protection Regulation (“GDPR”).
4.2 DFL will observe all legal provisions on data protection and data safety. All data of the User will be solely collected, processed and stored for the conduction of the Competition and deleted afterwards, unless DFL is legally required or entitled to further store the respective information.
4.3 The controller of personal data processed according to these Ts&Cs is DFL. The further data protection provisions including the rights of the User under the GDPR and the contact data of DFL’s data protection officer can be found in the privacy statement under the following link.
5. Other provisions DFL reserves the right to interrupt or shut down the Competition at any time without stating reasons. Especially reasons involving technology and/or legal matters, as a result of which the Competition can no longer be properly conducted, can be the basis for the end of the Competition.
5.2 The Competition is not connected to Instagram and is not sponsored, supported or organized in any way by Instagram. Instagram is not the contact person for the Competition. Questions regarding the Competition have only be addressed to DFL at info@bundesliga.com.
5.3 Legal recourse is excluded. Only the law of the Federal Republic of Germany applies.
5.4 Place of performance for the Competition is the registered office of DFL.
