Terms and conditions for taking part in the DFL’s product tester programme.
1. Terms and conditions for product testers
1.1. The following terms and conditions explain the key points if you would like to become a product tester for DFL Deutsche Fußball Liga GmbH (“the DFL” or “we”). Please read them carefully, because product testers must comply with them at all times. When the terms and conditions refer to products, this means digital products such as our websites and apps.
1.2. These terms and conditions can also include additional instructions and rules (see Clauses 3.2 and 3.3) that we will send you together with the invitation to a particular product test.
2. Signing up as a product tester
2.1. In order to take part in the DFL’s product tests, you must first register. When signing up, you must provide various pieces of information about yourself. We need some of this data and this information to allow you to take part in the product tests, so you must provide it. You can choose whether you want to provide us with the further data and information. This will all become clear when you sign up.
2.2. As our product tester, you must be at least 8 years old. If you are younger than 14 years old, your parents must give their permission for you to become a product tester. When you sign up, you must therefore provide the e-mail-address of your legal guardians. If you are between 14 and 18 years old, you confirm when registering that you have your legal guardians’ permission to become a product tester. For this reason, please talk to your legal guardians about this so that you can get started as a product tester right away.
2.3. After registration, we will send you an e-mail in which you must confirm that you have signed up as a product tester by clicking on a link in this e-mail. If you are younger than 14 years old, we will also send your parents an e-mail so that they can give their permission for you to become a product tester. You are only actually signed up once we receive your confirmation and that of your parents, if applicable.
2.4. You can only register as a product tester once. Please only sign yourself up as a product tester. If your friends, for example, also want to become product testers, they must sign up themselves.
2.5. As a product tester:
- You must not do anything that could jeopardise or disrupt product tests and must make sure that you do not send us any data with viruses, worms, Trojan horses or other malware.
- You must take the necessary data backup precautions the whole time you take part in product tests. Above all, you must handle any login details we may give you with care.
- You must support us so that we can clear things up if strangers interfere with the product test.
2.6. If we want to test new products and you would be a suitable product tester, we will send you an e-mail. This e-mail will give you all the additional information about this product test. Unfortunately, you cannot test all of our products. So, please understand if you do not hear from us for a long time or we decide to stop running such product tests. Just because you have signed up as a product tester does not mean that we have to send you products to test.
2.7. We can reject your registration as a product tester without giving a reason.
2.8. When you register, you declare that all the information you have provided is correct and up to date. Please inform us as soon as possible about any changes. To do so, simply send an e-mail to crm@bundesliga.de and tell us what has changed.
3. Testing products
3.1. If we select you for a product test, we will send you an e-mail with additional information before the product test begins. You can choose whether to take part or not. If not, you can simply ignore our e-mail.
3.2. For some product tests, we may need to provide you with a product or login details for a product free of charge. You may use the product or login details only for the specific product test. You must not share the product or login details with anyone else, publish them or sell them.
We may issue additional instructions and rules for a product test, which you must then follow and comply with.
3.3. A product may be subject to additional terms and conditions (e.g. with regard to data privacy or their use). You must comply with additional these terms and conditions if you take part in a product test.
3.4. As part of the product test, we will ask you to evaluate the tested product, e.g. by filling out a feedback form or other surveys or joining us on a video call. Other formats (e.g. face-to-face meetings) are also possible. You can also e-mail us your suggestions for improvement and other feedback at any time. We may make unlimited use of your evaluation and feedback for the purposes of the product test (especially but not limited to the optimisation, improvement and further development of our products). You grant us the necessary rights of use exclusively and for free with no restrictions in terms of time, territory or content. If it is necessary, we may edit your evaluation and feedback and combine them with other content.
3.5. You must not infringe the rights of other persons or companies with your evaluation or feedback.
3.6. Everything that you do for us as a product tester, you do voluntarily and for free. This means that you will not receive and cannot demand any payment for taking part in a product test or for the ideas and suggestions for improvement you express in your evaluation or feedback, even if we use your evaluation or feedback in the product or in the further development of the product.
4. Rights to digital products
All products you test and their contents belong to us. This means that you must use them only as we permit for the product tests. The contents of the products (e.g. videos, photos, articles, logos) are also legally protected.
5. Confidentiality
The products or features you test for us may not yet be more widely known and are therefore confidential. For this reason, you must not tell anyone except your legal guardians that you are taking part in a product test for us, that such a product test is even taking place, how it is going or what the results are. You must also not tell anybody anything about new products or show them what the product looks like.
6. Stopping being a product tester
If you no longer want to be a product tester or your parents no longer want you to be one, write us an e-mail at crm@bundesliga.de. You can register as a product tester again at any time. We also reserve the right to remove registered product testers from our product tester team and/or to terminate our product tester programme without disclosing the reasons. We will of course give advance notice if someone is no longer to be part of our product tester team or if our product tester programme is coming to an end.
7. Data privacy
7.1. So that we can send you appropriate products to test, you must register in advance and give us some information and data about yourself (name, age, e-mail address, country, favourite club) and about the smartphone you use (operating system). We will use this information to contact you and to allocate your evaluation of and feedback on the products. If you take part in a product test, we will collect further information and data (feedback or conversations over video, which we record). The legal basis for the registration and resulting participation in the product tests is Art. 6 para. 1 sentence b) of the European General Data Protection Regulation (“GDPR”).
7.2. We will place what is known as a tracking pixel in the HTML code of the e-mails we send for the organisation and conduction of the individual product tests and assign each product tester a user ID to determine when the e-mail with the product test was opened and which links or functions you clicked. All this is in order to improve the messages we send you and our other product testers. Of course, we will not share such information and data with others.
If you do not want this, you can deregister from the product tests at any time.
7.3. We collect, store and use your all information and data only for the preparation of product tests, your participation therein, and the analysis of such product tests. We will delete such information and data at the latest when you have been inactive for three years. We will delete your evaluations and feedback after two years at the latest. Otherwise, we will delete your information and data as soon as we no longer need it or are no longer obliged to retain it.
7.4. We are responsible for processing your information and data in accordance with these terms and conditions. You can find further information on data privacy (e.g. your rights under the GDPR) and how to contact our data privacy officer in our privacy statement.
8. Changes to the terms and conditions
We may have to change these terms and conditions. If we do so, we will send you (and if you are under 14 years old, your parents) an e-mail 14 days beforehand with the changed terms and conditions so that you (and your parents) can decide if you wish to remain a product tester.
9. Miscellaneous
9.1. German law applies with the exception of legal norms that invoke another jurisdiction. Private international law and the United Nations Convention on Contracts for the International Sale of Goods (CISG) do not apply.
9.2. If one or more provisions of these terms and conditions are ineffective, this does not mean that these terms and conditions as a whole are ineffective. The other provisions remain effective.
