1. Online evaluation survey and raffle
1.1 DFL Deutsche Fußball Liga GmbH, Guiollettstrasse 44-46, 60325 Frankfurt/Main, Germany, ("DFL" or "We") is conducting an online evaluation survey from 22 January 2025 until 2 February 2025 at 23:59 (CET) on the German and English versions of its official website bundesliga.com and its official Bundesliga App (hereinafter collectively referred to as "Digital Media") to obtain feedback from users of the Digital Media in order to optimise it and adapt it to the wishes and needs of users. 

After taking part in the online survey, participants can enter a draw for 1 x 2 tickets for a Bundesliga or Bundesliga 2 match (regular tickets, further rules on this in Clause 3.2 to 3.5) by entering their email address ("Raffle").

Participation in the Raffle and how it is conducted are governed by these Terms and Conditions ("Ts&Cs"), which the participant ("Participant") recognizes as binding by participating in the Raffle.

1.2 Any submissions received after the online evaluation survey has ended will not be considered.

2. Authorization to participate and win
2.1 Only individuals who have reached the age of 18 years are entitled to participate in the Raffle.

2.2 Participation in the draw is free and voluntary, i.e. the user can also just take part in the online evaluation survey.

2.3 Any false or fake personal information provided by the Participant authorizes Us to exclude him or her from the Raffle.

Participants who secure an illegal advantage over other Participants, or whose entries contain immoral, slanderous, discriminatory, disgusting or other illegal material, or which show or call for illegal activities will also be excluded from the Competition. Automatic computer-generated entries, multiple entries and multiple entries under different email addresses are not permissible and will not be considered in the draw. 

Our Employees, the employees of companies affiliated with Us within the meaning of §§ 15 et seq. German Stock Corporations Act (Aktiengesetz, "AktG") and DFL Foundation, employees of Our licensees, partners and sponsors, contractual partners and of those of companies affiliated with Us within the meaning of §§ 15 et seq. German Stock Corporations Act (Aktiengesetz, "AktG") and DFL Foundation are excluded from participation. The respective relatives of all these employees are also excluded from participation.

We can demand return of a prize that has already been granted in all the above-mentioned situations.

2.4 An alternate winner will be determined by conducting a new draw excluding the original winner in the following cases: (i) the winner has not reached the age of 18 (ii) We reclaim a prize already distributed in accordance with Clause 2.3, (iii) the winner fails to contact Us within the period specified in Clause 3.1 and/or (iv) the winner provides false or fake personal information.

3. Prize notification
3.1 The winners will be drawn and notified by email until 7 February 2025. The winner is obliged to contact us within seven calendar days after sending this notification. If the winner fails to do so, the prize will be forfeited. In this case, We will either select an alternate winner by conducting another draw excluding the original winner, or let the prize lapse, at Our own discretion.

3.2 Winning tickets does not entitle the winner to attend a specific match and/or a match of a specific Bundesliga or Bundesliga 2 club. We will of course do our best to fulfil the wishes of the winner. The final selection will be made by Us depending on the ticket availability.

3.3 The claim for the prize will be forfeited if the prize cannot be redeemed until the end of the second leg of the season 2024/2025 due to reasons which lie solely in the person of the winner or in his/her area of responsibility (e.g. no match attendance possible due to illness).

3.4 Winning tickets entitles the winner and his/her accompanying person exclusively to their private, non-commercial use. Any commercial or business resale and any other unauthorized transfer or offering of tickets by the winner is prohibited. In particular, he/she is prohibited from offering, selling and/or passing on the tickets publicly, in particular at auctions or on the Internet (e.g. on Ebay, Ebay classifieds, Facebook) and/or on sales platforms not authorized by DFL and/or the participating Bundesliga clubs (e.g. viagogo, seat-wave, StubHub), or passing them on to persons who are banned from attending stadiums or who have been banned from attending sporting events in the last five years for security reasons.

In addition, the General Ticket Terms and Conditions of the home team whose match the winner will attend also apply.

3.5 Any expenses and incidental costs which are not expressly indicated in these Ts&Cs have to be borne by the winner, especially but not limited to the travel from/to the stadium, possible accommodation, telephone/internet, food, room-services charges, parking fees, insurances, visa and gratuities. 

3.6 The claim for the prize is not transferrable. A cash payout or payout with physical items is excluded.

3.7 We will not bear any further costs, in particular due to the non-delivery of a prize to the address named by the winner.

3.8 Possible taxes and fees in connection with a prize must be borne the winner.

4. Data privacy
4.1 If there is any suspicion that the tickets have been resold by the winner contrary to Clause 3.4, We may share the name and contact details of the winner with the participating clubs, so that they can take sanction measures against him/her. The legal basis for the transmission is the legitimate interest of DFL and the participating Bundesliga clubs pursuant to Art. 6 para. 1 sentence 1 f) of the European General Data Protection Regulation ("GDPR"). Our interest consists in the prevention of the unauthorized ticket resale.

4.2 In the event that it is necessary to redeem a prize, We will ask the winner for additional contact information (e.g. first and last name, postal address). If the prize or part of the prize is redeemed through retailers or other providers, We are entitled to share the contact data of the winner with the respective retailer or provider so that they can contact the winner. The legal basis for processing is Art. 6 para. 1 sentence 1 b) GDPR.

4.3 We will observe all legal provisions on data protection and data safety. All personal data of the Participant in connection with the Raffle will be solely collected, processed and stored for its conduction and deleted afterwards, unless We are legally required or entitled to further store the respective personal data. 

4.4 The controller of personal data processed according to these Ts&Cs is the DFL. The further data protection provisions including the rights of the Participant under the GDPR and the contact data of Our data privacy officer can be found in the Privacy Statement under the following link.

5. Warranty and liability
The following provisions apply for Our warranty and liability for the Raffle provided free of charge, regardless of the legal basis:

5.1 Our liability is limited in amount to the harm typically foreseeable when concluding the contract in the case of minor negligent violation of primary duties [Kardinalpflichten] (i.e. material duties which must be fulfilled by Us and which are of major importance for achieving the purpose of the Raffle or which must be complied with by Us and which, if violated, can result in endangering achievement of the purpose of the contract). We are not liable for minor negligent violation of other duties.

5.2 We assume no warranty for defects in substance and/or defects in title with regard to the prize. The winner can only assert warranty claims against the respective supplier. If the prize or a part of the prize is provided by a partner, We are also not liable for any insolvency of this partner and the consequences of insolvency. Exclusion of the above liability for defects in substance and/or defects in title on the part of DFL does not apply if the defect in title or in the item was fraudulently not disclosed by Us.

5.3 The above limits and exclusions on liability and warranties do not apply in cases in which liability is mandated by law, especially in the case of culpable injury to life, physical integrity and health or claims under the German Product Liability Act [Produkthaftungsgesetz]. To the extent that Our liability is excluded or limited, this also applies for the personal liability of corporate bodies, employees, representatives and agents. 

6. Other provisions
6.1 We reserve the right to interrupt or shut down the Raffle at any time without stating reasons. Especially reasons involving technology and/or legal matters, as a result of which the Raffle can no longer be properly conducted, can be the basis for the end of the Raffle.

6.2 Legal recourse is excluded. Only the law of the Federal Republic of Germany applies.

6.3 Place of performance for the Raffle is Frankfurt am Main.
